The following are the terms and conditions of the Brand Ambassador agreement, per Fyve, Inc.

A. As a Fyve Brand Ambassador, I agree to the following

1. I am 18 years of age or older.
2. I am not an employee, agent, franchisee, or partner of the company. I cannot act on behalf of the company. I do not have any authority to incur debt, obligation, or liability on behalf of the company.
3. I will receive products from Fyve at a discount using my discount code and will post pictures and/or videos on Instagram, Instagram stories, Facebook, TikTok, Youtube and other social media outlets.
4. I will share content using our brand hashtags: #fyvebeauty #fyvetribe
5. I will post as often as I would like on social media accounts using the brand hashtags listed in item #4. I can also repost Fyve’s posts as often as I’d like.
6. I must be an active Brand Ambassador to remain in the program. Active means posting on Instagram stories and Instagram once per product that is received.
7. I will receive a $25 to $50 Fyve gift card for my images and/or videos if they are to be used for email marketing or website content. I will not receive cash value for any unused or unredeemed gift cards. Gift cards have no expiration date. When given the gift cards, Fyve, Inc. will own the rights to use the image for email marketing or website content.
8. I understand that I will not receive monetary compensation or gift cards for use of images or videos used on the company’s social media outlets. Fyve, Inc. will always give photo credit to you if we use the images or videos.
9. I will receive 30% off the Fyve website when placing an order using my exclusive Brand Ambassador promotion code that was/will be sent to me.
10. I will not share my exclusive promo code with anyone unless I have consent by Fyve, Inc.
11. I will not sell company product on unauthorized websites on the internet or in retail establishments.
12. If I choose to leave the Brand Ambassador program, my gift cards and/or rewards points will always be active.
13. I agree that the company reserves the right to cancel this agreement at any time.
14. If I choose to leave the program, a simple written notice to Fyve is required.

B. Fyve, Inc. understands:

1. Company will compensate the Brand Ambassador anywhere from $25 to $50 Fyve Gift cards for every photo we use on our website or email marketing, or advertisements, but not on social media networks. Once compensated, Fyve Inc. owns the rights to use this image for campaigns even should the Brand Ambassador leave the program.
2. Company may provide free products, exclusive promos, and free gifts to the Brand Ambassador.
3. Company will provide an exclusive promo code of 30% off sitewide.
4. If the company terminates the program, they must give 30 days written notice to all Brand Ambassadors.

C. General:

1. Either party may terminate this agreement immediately for cause or without reason upon written notice.
2. Fyve, Inc. may discontinue the Brand Ambassador Program at any time.
3. The Brand Ambassadors will not be treated as a company employee for any reason.
